1. Scope and Overview

This Privacy Policy describes how FadedCloud ("FadedCloud," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information in connection with our websites, billing and control panels, game server hosting, support channels, and related products and services (collectively, the "Services"). It applies to customers, prospective customers, website visitors, and other individuals who interact with the Services.

FadedCloud operates from the United States and uses applicable United States federal and state privacy laws as its primary compliance framework. We may offer Services to customers outside the United States where legally and operationally available. Where a mandatory privacy or data-protection law outside the United States applies to our processing, we will honor the rights and obligations required by that law. Nothing in this Privacy Policy is intended to limit a privacy right that cannot lawfully be limited or waived.

2. Our Role

FadedCloud generally acts as the business or data controller for personal information used to create and administer customer accounts, process orders, provide support, secure the Services, and operate our business.

When a customer uses the Services to upload, host, transmit, or otherwise process personal information about other individuals, that customer determines the purposes and means of that processing. In that context, the customer is generally the business or data controller, and FadedCloud acts as a service provider or data processor on the customer's behalf, as defined by the applicable contract and law. Customers are responsible for providing any required notices, obtaining any required permissions or consents, responding to requests from individuals, and ensuring their use of the Services complies with applicable privacy and data-protection laws.

3. Information We Collect

Depending on how you interact with the Services, we may collect the following categories of information:

Account and contact information. Your name, email address, username, account identifier, billing address, country or region, and other information you provide when creating or updating an account.

Order and transaction information. Services purchased, invoices, subscription and renewal information, transaction identifiers, payment status, selected currency, tax information, and related billing records. Payment card and other payment credentials are processed by third-party payment providers and are not stored directly on FadedCloud's own servers.

Service and customer content. Server names, configuration data, files, worlds, databases, logs, backups, and other content you upload to, generate through, or store on the Services. We access customer content only as reasonably necessary to provide support, maintain or secure the Services, enforce our agreements, or comply with law.

Support and communication information. The content of support tickets, emails, contact-form submissions, Discord communications directed to our support team, and other communications with us, including attachments and relevant account details.

Device, usage, and log information. IP address, browser type, device and operating-system information, referring pages, pages visited, access dates and times, session information, diagnostic data, server and application logs, and information about your interactions with the Services.

Cookies and similar technologies. Cookie identifiers, preferences, authentication information, and limited analytics information as described in Section 6.

Information from third parties. Information received from payment processors, fraud-prevention providers, infrastructure providers, authentication services, or other vendors when needed to complete a transaction, verify an account, prevent abuse, or provide the Services.

We ask that you not provide sensitive personal information unless it is necessary for a specific, authorized purpose. Please do not submit government identification numbers, financial account credentials, health information, or similarly sensitive information through Discord or ordinary support communications.

4. How We Use Information

We may use personal information to:

• provide, provision, configure, maintain, and manage the Services;
• create and administer accounts and authenticate users;
• process orders, payments, renewals, refunds, invoices, taxes, and billing disputes;
• provide customer support and communicate about accounts, maintenance, outages, security, and policy changes;
• monitor performance, troubleshoot errors, and improve the reliability and functionality of the Services;
• detect, investigate, prevent, and respond to fraud, abuse, unauthorized access, security incidents, Terms of Service violations, and unlawful activity;
• comply with legal, tax, accounting, sanctions, export-control, and regulatory obligations;
• establish, exercise, or defend legal claims and enforce our agreements; and
• create aggregated or de-identified information that no longer reasonably identifies an individual.

We do not use personal information for purposes that are materially incompatible with those described in this Privacy Policy unless we provide additional notice or obtain consent where required by law.

5. Legal Bases for Processing

Where applicable law requires us to identify a legal basis for processing, we rely on one or more of the following:

Contract. Processing necessary to enter into or perform a contract with you, including creating your account, processing your order, provisioning your server, and providing support.

Legitimate interests. Processing necessary for our legitimate interests or those of another party, including securing and improving the Services, preventing fraud and abuse, maintaining business records, and communicating with customers, provided those interests are not overridden by your rights and interests.

Legal obligations. Processing necessary to comply with applicable legal, tax, accounting, regulatory, sanctions, export-control, or law-enforcement obligations.

Consent. Processing based on your consent when consent is required. You may withdraw consent at any time, but withdrawal does not affect processing that was lawful before the withdrawal.

6. Cookies and Similar Technologies

We use cookies and similar technologies for essential functions such as authentication, security, session management, shopping-cart and checkout functions, and account preferences. We may also use limited analytics technologies to understand how the Services are used and to diagnose or improve performance.

You may control or disable cookies through your browser settings. Disabling essential cookies may prevent portions of the Services from working correctly. We do not currently use personal information for cross-context behavioral advertising, and we do not currently respond to browser "Do Not Track" signals. Third parties integrated into the Services may collect information under their own privacy policies. Where required by applicable law, we will request consent before using non-essential cookies or provide another legally required choice mechanism.

7. How We Disclose Information

We may disclose personal information to the following categories of recipients for the purposes described in this Privacy Policy:

Service providers and processors. Payment processors, billing and control-panel providers, fraud-prevention and security vendors, infrastructure and data-center providers, backup providers, email delivery services, analytics providers, and support tools that process information on our behalf or help us operate the Services.

Professional advisers. Attorneys, accountants, auditors, insurers, and other advisers when reasonably necessary to operate our business, manage risk, or protect our legal interests.

Government authorities and legal recipients. Courts, regulators, law-enforcement agencies, or other authorized parties when we reasonably believe disclosure is required by applicable law, subpoena, court order, or legal process, or is necessary to protect the rights, safety, security, or property of FadedCloud, our customers, or others.

Business-transfer recipients. A buyer, investor, lender, adviser, or successor in connection with a proposed or completed merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, subject to appropriate confidentiality and legal restrictions.

Other recipients at your direction. A third party when you request or authorize the disclosure.

We do not sell or rent personal information for money. We also do not share personal information for cross-context behavioral advertising as those terms are defined under applicable United States state privacy laws. If our practices change, we will update this Privacy Policy and provide any notice or opt-out right required by law.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Services, maintaining account and transaction records, complying with legal, tax, accounting, and regulatory obligations, resolving disputes, preventing fraud and abuse, enforcing our agreements, and maintaining security.

Retention periods vary based on the type of information, the nature of the Service, the length of our relationship with you, backup and disaster-recovery cycles, legal requirements, and whether information is needed for an active dispute or investigation. When personal information is no longer required, we take reasonable steps to delete, de-identify, or securely dispose of it. Residual copies may remain in backups until they are overwritten or expire through normal retention cycles.

9. Your Privacy Rights and Choices

Depending on where you live and whether the relevant law applies to FadedCloud, you may have the right to:

• request confirmation of whether we process your personal information;
• request access to or a portable copy of your personal information;
• request correction of inaccurate personal information;
• request deletion of personal information, subject to legal exceptions;
• object to or request restriction of certain processing;
• withdraw consent where processing is based on consent;
• opt out of certain sales, sharing, targeted advertising, or profiling, if we engage in a covered activity;
• appeal a decision concerning a privacy request, where applicable; and
• submit a complaint to an applicable privacy or data-protection authority.

You may submit a request through our contact page, a support ticket, or by emailing [email protected]. Please use the subject line "Privacy Request" and describe the right you wish to exercise. We may need to verify your identity and authority before completing a request. Authorized agents may submit requests where permitted by law, subject to verification of their authority and the identity of the individual they represent.

We will respond within the period required by applicable law. We will not unlawfully discriminate or retaliate against you for exercising a privacy right. Some rights are subject to exceptions, and we may retain information when required or permitted by law. If information is necessary to provide an active Service, fulfilling a deletion or restriction request may require closure of the associated account or Service after we explain that consequence.

If we deny a request and applicable law provides a right to appeal, you may submit an appeal using the same contact method with the subject line "Privacy Appeal."

California residents. If the California Consumer Privacy Act, as amended, applies to FadedCloud's processing, California residents may have rights to know, access, correct, and delete personal information; to receive information about its disclosure; to opt out of covered sales or sharing; to limit certain uses of sensitive personal information; and to be free from unlawful discrimination for exercising those rights. As described above, FadedCloud does not currently sell personal information or share it for cross-context behavioral advertising. California residents may exercise applicable rights using the contact methods in this section.

Other U.S. state residents. Residents of several other states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, and others as those laws take effect) may have similar rights to know, access, correct, delete, and port personal information, and to opt out of targeted advertising or profiling in furtherance of decisions producing legal or similarly significant effects, to the extent those laws apply to FadedCloud's processing. Where applicable law defines "sensitive data" or "sensitive personal information" (such as precise geolocation or certain demographic categories), we will not process that category of data about you without your consent unless an exception applies. You may exercise applicable rights using the contact methods in this section, and, where the law provides for it, appeal a denied request using the same method with the subject line "Privacy Appeal."

10. International Users and Cross-Border Transfers

FadedCloud is based in the United States. Personal information may be transferred to, stored in, accessed from, and processed in the United States and in other countries where our service providers or infrastructure operate. Those countries may have privacy and data-protection laws that differ from the laws where you live.

When applicable law requires safeguards for an international transfer, we use an available lawful transfer mechanism or other required protection. Depending on the circumstances, these protections may include contractual safeguards with service providers or another legally recognized transfer mechanism. You may contact us for additional information about safeguards applicable to your personal information.

Offering the Services internationally does not change the governing-law, jurisdiction, and venue provisions in our Terms of Service. However, those provisions do not limit any privacy right, regulator authority, or remedy that cannot lawfully be limited or waived under a mandatory privacy or data-protection law applicable to our processing.

11. Data Security and Breach Response

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, acquisition, alteration, disclosure, destruction, or loss. These measures may include access controls, least-privilege practices, authentication controls, logging and monitoring, security updates, backups, and encryption in transit where appropriate.

No security measure, transmission method, or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your account credentials, using strong and unique passwords, enabling available security features, and promptly notifying us if you suspect unauthorized account activity.

If we discover a personal-data breach, we will investigate and take reasonable steps to contain and address it. We will notify affected individuals, customers, regulators, or other parties when and as required by applicable law.

12. Third-Party Services

The Services may integrate with or link to third-party services, including payment processors, billing and game-control panels, Discord, and review or analytics platforms. A link or integration does not mean we control the third party. Third parties process information under their own terms and privacy policies, and we encourage you to review those policies. FadedCloud is not responsible for the independent privacy practices of services we do not operate.

13. Children's Privacy

The Services are intended for adults and are not directed to individuals under 18. You must be at least 18 years old, or the age of majority where you reside if that age is higher, to purchase or use the Services.

We do not knowingly collect personal information from a child under 13 in violation of the United States Children's Online Privacy Protection Act. If you believe a child has provided personal information to us contrary to this section, contact us at [email protected]. If we determine that personal information was collected in violation of applicable law, we will take appropriate steps to delete it.

14. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Services, our data practices, legal requirements, or business operations. When we make changes, we will update the "Last updated" date. If a change is material, we will provide additional notice when required by applicable law, such as through the website, account dashboard, or email. We encourage you to review this Privacy Policy periodically.

15. Relationship to the Terms of Service and Governing Framework

This Privacy Policy should be read together with our Terms of Service. To the fullest extent permitted by applicable law, disputes arising out of or relating to this Privacy Policy or the Services are subject to the governing-law, jurisdiction, and venue provisions in Section 17 of the Terms of Service, which provide for applicable United States federal and state law and a forum within the United States. Nothing in this section limits a right or remedy that cannot lawfully be limited or waived.
